With the newest change to PL265.20
¶7-e, permitting 14-20 year olds to possess and use a pistol or revolver
on a range or during a sanctioned competition, our community has a wonderful
chance to encourage young new shooters.
But, it has created a strange
situation. Now a 14-20 year old has more rights and privilege then a 65-year
old honorably discharged war vetran, as those above the age of twenty, who are
residents of NYS, must have a pistol license to possess and use a
pistol/revolver.
PL265.20 ¶7-e, needs to be modified so that there
is NO upper limit, if you are on a range or at a sanctioned competition, to
possess and use a pistol/revolver. The code change to PL265.20 ¶7-e is
simple, JUST REMOVE THE WORDS "but under the age of
twenty-one" FROM THE LAW.
Assemblywoman DelMonte's Bill A7962 is
the start of this process. This bill will modify NYS PL265.20.7e, so that a
"...person be at least fourteen years of age, with no
maximum age, for the possession and use of a pistol or revolver at a
pistol range." This is a VERY good thing for NYS Sportsmen. You can read the

This
bill is in the Codes Committee of the NYS Assembly, and needs a companion bill
in the NYS Senate.
Important, please: 1)
Call Assemblywoman DelMonte (518-455-5284) and say 'thank you' for Bill
A7962. 2) Call NYS Assembly-critter and have them sign onto Assembly Bill
A7962. If they will not sign onto it, try to get them to support it at vote
time. 3) Call NYS Senator Volker's office (518-455-3471) and request a
companion bill to be created in the NYS Senate. Word has it that he will create
the companion bill, but a show of support can never hurt.
This is important, and GOOD, legislation for NYS, as it will
help our community introduce our sport, and our views, to more
people!! |

Summer 2006 *** NYS PL265.20 ¶7-e NYS Juniors, ages 14 to 20 CAN
POSSESS & USE A PISTOL/REVOLVER
A careful examination of
this law, shows a very positive stance for our position. The analysis below was
reviewed by a lawyer friend of mine, who helped with the Junior Bill from the
beginning, Though he is a lawyer, there is always room for a different
interpretation, but I like this one.
Additionally, note that there is
NO exemption for NYC to 'opt' out, as the 14-20
age issue is a blanket exemption.
The law: PL265.20 ¶7-e.
Possession and use of a pistol or revolver, at an indoor or outdoor pistol
range located in or on premises owned or occupied by a duly incorporated
organization organized for conservation purposes or to foster proficiency in
small arms or at a target pistol shooting competition under the auspices of or
approved by an association or organization described in paragraph 7-a of this
subdivision (READ: ...national rifle
association of America & IHMSA) for the purpose of loading and
firing the same by a person at least fourteen years of age but under the age of
twenty-one who has not been previously convicted of a felony or serious
offense, and who does not appear to be, or pose a threat to be, a danger to
himself or to others; provided however, that such possession shall be of a
pistol or revolver duly licensed to and shall be used under the immediate
supervision, guidance and instruction of, a person specified in paragraph seven
of this subdivision (READ: ...(a) a duly
commissioned officer of the United States army, navy, air force, marine corps
or coast guard, or of the national guard of the state of New York; or
(b) a duly qualified adult citizen of the United States
who has been granted a certificate as an instructor in small arms practice
issued by the United States army, navy, air force or marine corps, or by
the adjutant general of this state, or by the national
rifle association of America, a not-for-profit corporation duly
organized under the laws of this state; or (c) a parent,
guardian, or a person over the age of eighteen designated in writing by
such parent or guardian who shall have a certificate of qualification in
responsible hunting, including safety, ethics, and landowner relations-hunter
relations, issued or honored by the department of environmental conservation;
or (d) an agent of the department of environmental conservation appointed to
conduct courses in responsible hunting practices pursuant to article eleven of
the environmental conservation law).
An analysis of the (to be)
law:
- Possession and use of a pistol or
revolver, at an indoor or outdoor pistol range located in or on premises owned

[READ: A person age 14 to 20 (inclusive), who appears to
pose no threat of a danger to himself or others, may load and fire (including
training, practicing, plinking, competition, etc.) a lawfully owned pistol or
revolver on a legitimate shooting range under the immediate supervision of a
parent or certain others specified in the law.]
- Possession and use of a pistol or
revolver, ... at a target pistol shooting competition under the auspices of or
approved by an association or organization described in paragraph 7-a of this
subdivision for the purpose of loading and firing the same by a person at least
fourteen years of age but under the age of twenty-one who has not been
previously convicted of a felony or serious offense, and who does not appear to
be, or pose a threat to be, a danger to himself or to others; provided however,
that such possession shall be of a pistol or revolver duly licensed to and
shall be used under the immediate supervision, guidance and instruction of, a
person specified in paragraph seven of this subdivision. [READ: The same juniors can load and fire a lawfully owned
pistol or revolver at an NRA or IMHSA sanctioned competition under the same
supervision. This provision allows loading and firing at any place where the
competition is taking place, and is not technically limited to the types of
ranges specified in the part of the law authorizing possession by juniors at a
legitimate range.]
- Bear in mind...POSSESSION OF A HANDGUN ANYWHERE OFF OF THE RANGE OR OUTSIDE
THE COMPETITION SUBJECTS THE YOUTH TO PROSECUTION AS A
FELON.

New teams forming in Riflery and Air Pistol at
the Freeport R & R Association Junior Club. Disciplines include "BB",
.177 Pellet and .22 Rifle.
You can qualify as a Pro-Marksman, Marksman,
Marksman 1st Class, Sharp Shooter, Expert and Distinguished Expert. Both NRA
and CMP programs are available. Riflery is one of the safest sports offered for
children and young adults.
